TCH Mobile PRIVACY POLICY NOTICE 

Welcome to TCH Mobile, and digital and online services, information, and communication provided by Tzu Chi Hospital as a brand of Yayasan Buddha Tzu Chi Medika Indonesia (“TCH” or ‘’We’’ or “Our” or “Us”) 

This Privacy Policy Notice (“Privacy Policy”) provides explanation on how information of TCH Mobile user (“User” or “You”) is collected, used, shared and protected for confidentiality by Tzu Chi Hospital while respecting User’s rights to privacy in using TCH Mobile ("Application"). 

A. Scope of Privacy Policy. 

1. This Privacy Policy applies to Application and other digital online services where it is posted.
2. This Privacy Policy explains the usage, sharing, storing and protection of information provided by and collected from the User when User uses the Application.
3. Upon downloading and using the Application, the User is deemed to have read this Privacy Policy and its updates, and given consent to the mechanisms the User's personal data is received/collected, used, shared and protected as set out in this Privacy Policy.

 

B. Privacy Policy Updates 

We may need to update our Privacy Policy responding to changes in technology and as the Application and TCH evolves. We shall post a message on our Application should We make material changes to this Privacy Policy

 

C. Registration 

1. User’s are required to register in the Application prior to being able to use the Application with the services or features contained in it
2. To register in the Application, the User must provide the information as stated in Article D below.

 

D. Personal Data 

1. Mandatory information about the identity that must be filled out by the User when registering in the Application is

• Date of birth according to the valid personal identity card (KTP or Passport)
• URN number issued by TCH
• Mobile phone numbers

 

E. Use of Collected and received information

1. We use User information We collect and receive to:
   • Provide information to User’s at User's request in connection with Our services on each feature in the Application.
   • Health Services currently being performed by the User.
   • Use and reveal User health information following Application operational requirements. We may use and distribute the information to evaluate and enhance the quality and health Services We provide, as well as the competence and qualifications of Doctors and/or Application professional staff.
   • Provide information/send promotional emails and/or SMS periodically to the User when there is an offer and/or promotion for new products, special offers, or other information that We consider relevant for the User.
   • Inform the User regarding every change from Application, Our Services, and Products. 
   • Use the User information, as in the Personal Data already provided by User upon admission to TCH, to contact the User and remind the Doctor’s appointment scheduled through Application.
   • Use and reveal User information when required for medical evaluations, professional advice, and audits, including fraud and abuse detection and adjustment programs, business planning, and management.
   • Our internal records or documentation are saved on Our servers.
   • We will use the collected data for statistical data processing, the outcomes of which will be used for medical and commercial evaluations. The large majority of this statistical data processing will not reveal Personal Information, but it is possible that it will reveal Personal Information while tracking the processing's results. By using Application, the User is assumed to have understood and agreed to the use of this information.
2. We assure the information and data that the User provides will stay private and will not be shared. To prevent unauthorized access, We enforce physical, electronic, and administrative protections to secure User information.
3. The User's health information will only be used in association with Application services and the Doctor's medical evaluation, and We will only collect the information required to provide the service.
4. We save User 's personal information for as long as the information is relevant to the needs of Our service to User’s. The User's personal information is kept private and will not be revealed except if permitted by the applicable laws and regulations.
5. By using Application, the User is considered to have given consent to certain third parties using User data to provide User with the required product and service information. Among these third parties are, but not limited to:

• User Insurance who needs a consultation or service permission or who require evidence of services provided and/or a medical report before paying Application.
• Third-party providers who have delivered services to the User or the User’s Doctor (such as x-ray or laboratory services) to obtain checkup results or to generate receipts.
• Our business partners, such as those who handle Our billing or administration. We have a cooperation agreement with each business partner and all service providers who are obligated to keep the information sent to them privately and secure.

 

F. Conditions to Access this Application

By accessing this Application, the User represents and guarantees that the User is an individual who can legally enter into a binding agreement under the prevailing laws of the Republic of Indonesia, and that the User is at least 18 (eighteen) years of age or married or not under trusteeship. 
User who is under 18 (eighteen) years of age and not married, or under trusteeship must comply with the following conditions:

1. User must obtain written consent from User’s parent or legal guardian; and
2. The User's parent or legal guardian is responsible for: (i) all User’s actions in connection with access and use of the Application by the User; (ii) User’s compliance with this policy; and (iii) ensuring that any access to and use of this Application will not, in any case, result in a violation of the prevailing laws and regulations related to child protection.

 

G. Connection of user to Another Applications

1. Application includes links to another applications for the User's reference. If the User clicks on this link, We are not responsible for protecting the User's privacy or any information provided by the User when accessing another applications. 
   User shall bear full liability for any and all risks and consequences from accessing another applications. We do not have any obligation for protecting User from any perils. User shall release Us from any and all claims in relation to User accessing another applications.
2. The User will be linked to the application controlled by Our Payment Gateway for the sole purpose of making payment transactions. We always take reasonable precaution to protect the information the User provides to complete the payment transactions.

 

H. Applicable Laws and Regulations

This Privacy Policy is governed by and construed in accordance with the prevailing laws and regulations of the Republic of Indonesia. User is obligated to comply with all applicable and prevailing laws and regulations in Indonesia.

 

I. Security Efforts 

1. We always make reasonable efforts and care to ensure that User information is protected and cannot be accessed by irresponsible parties. However, the User understands and agrees that data transmission through Internet to and from the Application is not always secure. As a result, any messages or information sent to or used by User in the Application can be detected, intercepted, or acquired by irresponsible third parties. 
2. We will store User personal data on Our database server located in the territory of the Republic of Indonesia. 
3. We are not responsible nor liable for all and any data that the User wants to or accidentally disseminates either intentionally or unintentionally. Users are deemed to voluntarily release the confidentiality of their Personal Data through such disclosure. 
4. It is deemed the User takes full obligation to protect access to the Application only by the User. TCH has no liability for any access to the Application. 

 

J. Questions, Concerns, Complaints and Contact

If the User has any question or concern regarding this Privacy Policy, User’s  rights, and User’s relationship with the Application, User is welcome to lodge the complaint or concern by sending an email to admission@tzuchihospital.co.id

 

Controlling Language

This Privacy Policy has been written in English, Indonesian and Mandarin. Any discrepancy, the English version shall prevail and be controlling.

This Application links to other websites and/or third party applications of which may have their own Privacy Policy.

 

Data Privacy of User under 18 years of Age

The provision of the parent’s or guardian’s written consent is mandatory as our legal basis in relation to TCH Mobile before collecting, processing and using personal data submitted by anyone under 18 years of age.
