TCH Mobile Terms and Conditions Of Use

 

TCH Mobile Privacy Policy Notice and this Terms and Conditions Of Use ("Terms") provide an explanation of the Privacy Policy and procedures and requirements for the Users ("Users" or “User” or "You") in using TCH Mobile ("Application").

I General Provisions

• These Terms and Conditions Of Use and Privacy Policy Notice are an agreement between the Users and We as the organizer of the Application.
• By agreeing to the Terms and Conditions Of Use and Privacy Policy Notice of the Application, the Users also agree to any changes, revisions, and/or additions which form an inseparable and integral part of the Terms and Conditions Of Use and Privacy Policy Notice.
• If the Users do not agree with any part or all of the contents contained in these Terms and Conditions Of Use and Privacy Policy Notice, the Users may delete the Application on his mobile device and/or not use the Application. 
  By installing and using the Application, the Users are deemed to have agreed with the entire Terms and Conditions Of Use and Privacy Policy Notice.
• Types of services which are available through the Application are:

  • TCH Information 
    Displaying information related to Us including but not limited to hospital profiles, doctor practice schedules, offers for health check packages and promotions, and other information.

  • Doctor's Appointment Service
    Users can make an appointment for consultation with or treatment by any one of the doctors in TCH.

  • Activity Information
    Users can view Scheduled services, history of visits and test reports for Laboratory, Radiology and Medical Check Up reports.

  • Health Articles
    Users can access health articles and information on this Application which will be updated from time to time.

  • Payment Service
    Payment for the transactions for TCH services may be made through TCH Mobile, this payment service is available to Users who make self payment for the full transaction values as shown in the invoices. The processing of payments through TCH Mobile is managed by third party payment gateway.

 

II Application Usage

• Users shall use the Application following all guidelines, notices, operational regulations, and instructions regarding the use of the Application and all changes thereof.

• The Users warrant all information or data that the Users enter into the Application are true and accurate.

• For Users with disabilities who have obstacles or difficulties in giving direct consent to the use of the Application, the Users represent and warrant that the Users have given the unconditional consent for using the Application on the Users behalf by any third party.  

• Users Permissions for Access to Features of Application on Users Devices (Android and iOS):

  • Internet
    Application requires an internet connection to monitor the Users' Internet condition and network to send notifications if there is a lost connection, which prevents Application from not functioning (optimally).

  • Camera
    Application may require the Users to upload photos. Users can use the Camera on Users’ device to take the photo and to do QR code scanning.

  • Access Photo, Gallery and Files
    For Andriod

    • Applications may require Users to upload photos and/or documents. The Users can access the Gallery and/or File Manager on the Users’ device to search for the required photo or file.

    • Applications may require Users to store data generated by Applications or third parties.

    • Users can access the Gallery and/or File Manager, to select photos and/or supporting documents needed for Our Telemedicine sessions.

  • For iOS

    • Applications may require Users to upload photos and/or documents. Users can access Photo and/or Folder on the Users' device to search for the required photos or files.

    • Applications may require Users to store data generated by Applications or third parties.

    • Users can access Photo and/or Folder, to select photos and/or supporting documents needed for Our Telemedicine sessions.

 

III Application Security 

1. TCH Mobile is designed to ensure the protection of data privacy and data security of the patient.
   TCH Mobile can be downloaded for free from Play Store (Android) or App Store (iOS) by User who is or is not already a patient of Tzu Chi Hospital Indonesia. General information about medical and clinical support facilities in Tzu Chi Hospital Indonesia is provided in TCH Mobile.  
   However, if a User is already a patient of Tzu Chi Hospital Indonesia and wishes to access the patient’s personal clinical data, the user is required to register in the Application prior to being able to use the Application with the services or features contained in it, and to sign up for the personal section of TCH Mobile, this is to protect data privacy and data security of the patient.
   When signing up, upon successful verification that the user is a valid Tzu Chi Hospital Indonesia patient, One Time Password for signing up is sent to the user’s mobile phone number registered at Tzu Chi Hospital Indonesia. To complete the signing up, user is required to create own username and password for subsequent logging in. The password must be a combination of uppercase, lowercase, numbers and special characters with a minimum of 10 characters.
   Whenever a user wishes to create a new password, a One Time Password will be required.
   TCH Mobile will logout automatically when it is left idle over 2 hours. User will be required to re-login.
2. Tzu Chi Hospital Indonesia uses encryption technology such as Secure Socket Layer (SSL) to protect your personal information during data transport. SSL protects information you submit via TCH Mobile, such as ordering information including your name and address.
3. We always make reasonable efforts to keep this Application up and running smoothly. However, We are not responsible and will not be responsible for the unavailability of the Application and/or Service features due to various reasons, including but not limited to maintenance requirements or technical problems. However, the Users acknowledge and agree that sending data via the Internet to and from the Application is not always safe. As a result, any messages or information sent to or used by Users in the Application may be detected, intercepted, or obtained by irresponsible third parties.
4. The Users acknowledge and agree that all risks arising from using the Application features by the Users remain entirely with the Users and the Users has no right to ask for any compensation from us. We do not provide representations or guarantees related to:

•  that this Application will be free from errors and/or defects or when operating in combination with other hardware, software, systems or data and that errors and/or defects in the Application will be corrected.

• Availability and use of Application and supporting servers that provide Application, including being free from viruses and other harmful components. 

• that the features in the Application will be in accordance with the expectations and needs of the Users.

• that the product quality, features and information provided will meet the expectations and needs of the Users. 

 

IV Limitation of Liability

1. By using the Application, the Users agree that We are not liable to the Users or to other parties under any circumstances including but not limited to negligence for any Use of the Application, loss or damage which is directly or indirectly caused by errors, omissions, deletions , delay or interruption in transmission, virus/malware, Internet access failure, data theft or destruction or unauthorized access, in any way related to or arising from the use, attempt to use or unsuccessful use of this Application and this Limitation of liability will remain in effect even if the Users no longer use the Application.
   We have taken reasonable measures to ensure the integrity and confidentiality of personally identifiable information that the Users may provide. We cannot warrant the security of any information the Users transmit to Us, and the Users do so at the Users own risk. The Users should understand that electronic transmissions through the Internet are not always secure from interception, hence We cannot absolutely guarantee the security or confidentiality of such transmissions.   

 

V Intellectual Property Rights

1. All brands, logos, images, icons, source code, or designs, as well as any data and information contained in the Application are legally owned by TCH and protected by prevailing laws.

2. Users or any party are strictly prohibited from copying, reproducing, storing, transmitting, republishing, modifying, creating derivative works, distributing,  displaying, licensing, renting or exploiting any content from the Application either in whole or in part by way of anything without Our prior written consent .

 

VI Others

1. We have the right to investigate and claim our rights for any violation of these Terms of Conditions of use to the extent that is permitted by law. Users hereby acknowledge that We have the right to monitor Users’ access to the use of the Application to ensure compliance with these Terms and Conditions Of Use .

2. We reserve the right, without prior notification, to void the User’s registration in the Application if manipulation or indications of fraud or violations committed by the User is found against these TCH Mobile Terms and Conditions Of Use.

3. These Terms and Conditions Of Use are governed by and construed in accordance with the prevailing laws of the Republic of Indonesia. In connection with our deregistration as referred to in paragraph 2 above, the Users and We agree to waive the provisions of Article 1266 of the Civil Code.

4. All disputes that arise between Users and Us in connection with the implementation of these Terms and Conditions Of Use will be resolved amicably by deliberation to reach a consensus. In the event that the dispute cannot be resolved by deliberation, the Users and We agree to resolve the dispute through the North Jakarta District Court.
